PRIVACY STATEMENT Independent Recruiters Group BV

This Privacy Statement is issued by the Independent Recruiters Group BV and all its parts: Independent Recruiters BV, Independent Professionals BV, Independent Hospitality BV, Independent Engineering BV, Independent Facility, Independent Public, Independent Retail and Independent Life Sciences, Recruitment Process Outsourcing hereinafter referred to as 'INDEPENDENT RECRUITERS'.  Independent Recruiters is responsible for the processing of personal data as part of the recruitment and selection process and for the processing of personal data when concluding and executing an employment or service agreement.

INDEPENDENT RECRUITERS adheres to the following general principles in its processing:

(a) it will only process personal data for the purposes stated in this statement, for which such personal data has been obtained.

(b) it will refrain from processing more personal data and will not retain personal data for longer than is absolutely necessary to fulfill the purposes for which it was provided and to comply with all legal obligations.

(c) it shall ensure the accuracy of personal data processed about you.

d) it shall ensure adequate security of your personal data by adopting, periodically evaluating and, if necessary, adjusting appropriate technical and organizational security measures aimed at preventing the loss and/or unlawful processing of personal data. INDEPENDENT RECRUITERS regularly evaluates whether the aforementioned measures are still at an appropriate and adequate security level.

FOR WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA?

1. For recruitment purposes.

 

(a) What do these purposes include?

When one of our recruitment consultants approaches you for a vacancy, when you apply for a vacancy, or when you register on INDEPENDENT RECRUITERS' recruitment website and have contact with one of our recruitment consultants about it, we include the personal data provided by you in those interactions in our recruitment database. We process your personal data to assess suitability for a position applied for or another available/upcoming position and to compare qualifications and other data with these vacancies. We process your personal data in order to manage our recruitment database. In this regard, we may alert you to potential positions in the future or contact and maintain contact with you, e.g. about recruitment-related activities.

 

(b) What are our legal bases for processing your personal data for these purposes?

First of all, INDEPENDENT RECRUITERS has a legitimate interest in processing personal data in order to assess your eligibility for a position within or outside the organization of INDEPENDENT RECRUITERS.

In addition, the legal basis for processing your personal data for these purposes is your "consent". By providing your data to INDEPENDENT RECRUITERS and/or by applying for a position with INDEPENDENT RECRUITERS, you expressly consent to the processing of personal data provided by you for the purposes described in paragraph 1(a) above. You thereby also declare that you have read and agree to this privacy statement. You have the right to withdraw this consent at any time without giving a reason. The withdrawal of your consent does not affect the lawfulness of the processing based on your consent prior to the withdrawal.

 

Furthermore, INDEPENDENT RECRUITERS processes personal data in order to fulfill its legal obligations and - if you are hired - to give effect to an employment contract or a service agreement.

 

The basis for the processing of personal data by INDEPENDENT RECRUITERS in the context of the recruitment and selection of employees is therefore found in Article 6(1)(a), (b), (c) and (f) of the General Data Protection Regulation (GDPR).

(c) What personal data do we process for these purposes?

For the purposes mentioned under 1, INDEPENDENT RECRUITERS processes the following data:

a. general data (including name, title, gender, date and place of birth; nationality and address and contact details);

b. resume, cover letter and other documents submitted by the applicant;

c. any photograph attached;

d. data concerning education, courses and internships attended;

e. data concerning the nature and content of current and previous employment and the termination thereof;

f. data obtained from declared referees and/or training institutes;

g. a copy of a valid identity document, if the applicant is to be employed;

h. a Certificate of Good Conduct (VOG);

i. a residence and/or work permit;

j. results of assessments and tests;

k. notes of job interviews;

l. other relevant data provided by the applicant;

m. data other than the aforementioned, the processing of which is necessary under a legal requirement.

 

CHECK: After the contact or receipt of the job application, INDEPENDENT RECRUITERS will provide an acknowledgement of receipt/a confirmation that the personal data obtained will be retained.

(d) How long do we keep your personal data processed for these purposes?

Your personal data will not be kept longer than necessary for the realization of the stated recruitment purposes. We will retain your data, e.g., in case other interesting job opportunities become available for you in the future. We will retain your personal data for no longer than one year after the end of the application process. We will retain your data for longer if you have given us your express written consent. You may withdraw this consent at any time without giving reasons.

 

 

(e) Who will have knowledge of your personal data being processed?

The data processed in the context of recruitment by INDEPENDENT RECRUITERS is accessible to the consultants and the supervisor under whose responsibility the position applied to falls.

 

2. To enter into an employment or service agreement with you.

(a) What does this purpose involve?

When we offer you a position at INDEPENDENT RECRUITERS, we will process your personal data to establish and process an (employment) agreement. We use your personal data to conclude, execute and terminate your (employment) agreement. We also include your personal data in our database.

If you are a self-employed contractor/entrepreneur, we will process your personal data in the same way to enter into and perform an agreement with you.

 

(b) What is our legal basis for processing your personal data for this purpose?

INDEPENDENT RECRUITERS processes personal data in order to comply with its legal obligations and to give effect to an employment contract or a service agreement and has a legitimate interest in doing so as an employer. In this context, you are obliged to provide said personal data.

 

The basis for the processing of personal data by INDEPENDENT RECRUITERS in the context of concluding and executing the (employment) agreement is therefore in Article 6, first paragraph, under b, c and f of the General Data Protection Regulation (GDPR).

(c) What personal data do we process for this purpose?

In addition to the parts a to m referred to in point 2c above, we also process for this purpose as relevant and/or necessary:

a. a copy of a valid identity document and BSN number;

b. statement of your employment status;

c.            Chamber of Commerce number;

d.           VAT data;

e. details of your function and position;

f. details of your work permit;

g. availability;

h. conditions of employment;

i. tax data;

j. insurance data;

k. payment information;

l. location and organizations.

 

(d) How long do we keep your personal data processed for this purpose?

For this purpose, your personal data will be retained until no later than two years after termination of your (employment) agreement, but longer (i) if INDEPENDENT RECRUITERS is required by law to retain your personal data or (ii) if reasonably necessary to protect the legal interests of INDEPENDENT RECRUITERS. Upon expiration of the retention period, your personal data will be deleted from our systems.

 

(e) Who will have knowledge of your personal data being processed?

The data processed by INDEPENDENT RECRUITERS within the framework of the conclusion and execution of the (employment) agreement is accessible to employees of the   HR department, management and the superior under whose responsibility the position applied to falls.

 

WHAT RIGHTS DO YOU HAVE?

With respect to the processing of your personal data by INDEPENDENT RECRUITERS, you have the following rights:

- right of inspection: you have the right to ask us to inspect the data we have processed about you;

- right to correction: you may ask us to correct or supplement any factual inaccuracies in the personal data;

- right to deletion: you have the right to ask us to delete your personal data, if: 

- right to transfer: you can ask us to provide you with your personal data in a structured, common and readable form.
